Wiser, more experienced attorneys than I have counseled me about legal arguments - including that when someone has the law but not the facts, they argue the law.
When they have the facts but not the law, they argue the facts.
When they don't have either, they just argue.
Gotta be honest, this turns into almost a poker tell for me - when I'm watching TV and someone on the news o(R) in the Senate comes out of the gate swinging with both fists, with neither the law nor the facts in either, I'll vet things and won't jump to conclusions, but their rant is well on the way to the circular file for me.
